Florida does not tax an individual's crypto gains or income, but the federal return still carries every trade. Here is what applies and who can help with the figures.

Short answer: Florida does not tax your crypto gains or crypto income, because Florida does not impose a personal income tax. Your federal return still reports every sale, swap and reward, so the crypto work is the federal reconciliation. Corporations are different: Florida taxes corporate income, including crypto gains, at 5.5 percent.

Florida is the simplest state in the country for an individual crypto investor. There is no state income tax return to file, no state rate on gains and no state schedule of trades. That does not make the crypto work disappear. The IRS still expects every disposal priced and matched to its cost basis, every staking or mining reward reported as income, and every transfer between your own wallets kept out of the gains figure.

This guide is for a Florida resident, or someone moving to Florida, who wants to know what the state adds to their crypto taxes and who should help. I am Chris Herbst, founder of CountDeFi. Does Florida Tax Crypto Gains or Crypto Income?

No, not for individuals. The Florida Department of Revenue answers the question directly: Florida does not impose a personal income tax, so there are no filing requirements. A crypto gain, a staking reward or crypto paid to you for work is not taxed by the state when you are an individual.

Is there a Florida return to file for crypto?

Not for an individual. With no personal income tax there is no Florida income tax return, so nothing about your crypto goes to the state. The same Department of Revenue answer adds that there are filing requirements for businesses, which matters if your crypto sits inside a company.

Does Florida charge any other tax on holding crypto?

The Department of Revenue lists the taxes it administers on its taxes and fees page. None of them is a tax on an individual's income or gains. If you spend crypto on goods or services, the spend is a federal disposal of the crypto, with a gain or loss measured against its cost basis.

Why do Florida residents still need crypto tax work?

Because the federal return carries the whole tax. A wrong cost basis, a transfer booked as a sale or a missing reward produces the same federal error whether you live in Florida or New York. In a state with no income tax, the federal figures are the only figures, so they deserve the full effort.

What the Federal Return Still Needs From a Florida Crypto Investor

The IRS treats crypto as property. Its digital assets page says that digital assets are considered property, not currency. Every sale, swap of one token for another and purchase made with crypto is a disposal with a gain or loss.

How are crypto gains taxed federally?

By holding period. Assets held for one year or less give short-term gains, and IRS Topic 409 states that net short-term capital gains are subject to taxation as ordinary income at graduated tax rates. Assets held for more than a year give long-term gains taxed at 0, 15 or 20 percent depending on taxable income, with the bands set out in the same topic.

How are staking and mining rewards taxed federally?

As income when you receive them. Rev. Rul. 2023-14 holds that the fair market value of staking rewards is included in gross income for the year in which the taxpayer gains dominion and control over the validation rewards. That value becomes the cost basis of the reward, so when you later sell it, only the change in value since receipt is a gain or loss. What about crypto paid for work?

Crypto received for services is income at its dollar value when received. The IRS states that the fair market value of virtual currency received for services performed as an independent contractor constitutes self-employment income and is subject to the self-employment tax. Florida adds nothing on top for an individual.

Where do crypto losses go?

Against your gains first. If losses exceed gains, Topic 409 limits the deduction against other income to the lesser of $3,000 ($1,500 if married filing separately) or your net loss, and the rest carries forward. Florida has no state return for the loss to reach, so the federal carryforward is the one to track.

For an individual the practical result is one set of crypto figures, all of them federal. For a company the same federal figures also feed the Florida corporate return.

Florida Corporations and Crypto Gains

Florida taxes corporate income. The Department of Revenue's corporate income tax page explains that the tax is imposed on all corporations for the privilege of conducting business, deriving income or existing within Florida, and that entities taxed federally as corporations are subject to it.

How is a Florida corporation's crypto gain taxed?

The starting point is federal taxable income, so crypto gains and rewards are inside it. That income is adjusted for Florida additions and subtractions and apportioned to Florida. The page states that you then subtract an exemption ($50,000 as of December 31, 2015) and apply the rate, which is 5.5 percent for tax years beginning on or after 1 January 2022.

Does an LLC that holds crypto pay Florida tax?

It depends on how the LLC is classified. The Department of Revenue states that a single member LLC disregarded for federal and Florida income tax purposes is not required to file a separate Florida corporate income tax return. An LLC classified as a corporation files and pays like a corporation. An LLC classified as a partnership files an information return only where one or more owners is a corporation. If your crypto sits in an LLC, confirm its classification before assuming no Florida tax applies.

Moving to Florida With Crypto

Many people move to Florida with gains already built up in their crypto. The move ends the state income tax on income earned after you become a Florida resident. It does not erase the rules of the state you are leaving.

Does my old state still tax a sale after I move?

The state you leave applies its own part-year resident rules, and those rules decide which income it taxes. A sale made while you were still a resident there is normally taxed by that state. The timing of residency, and the evidence for it, is a question for that state's rules and a preparer who knows them. What records help in the year I move?

A dated record of every disposal in the move year, split at the date residency changed. The reconciled federal history gives you exactly that, because each sale and reward already carries a date and a dollar value. Without it, the part-year return for the old state is built on estimates.

Choosing Crypto Tax Help as a Florida Resident

Since the state adds nothing for an individual, the help you need is federal: someone to reconcile the history and someone to file the return. These can be the same person or two people.

Who can file and who can represent me?

The IRS explains that enrolled agents, certified public accountants, and attorneys have unlimited representation rights before the IRS. Any of them can represent you in an audit or collection matter. A crypto reconciliation provider prepares the figures those professionals file from.

How do I check a Florida CPA licence?

Florida CPAs are licensed through the Department of Business and Professional Regulation. Its licensee search lets you verify a licence by name or licence number before you engage anyone who uses the title.

Does the specialist need to be in Florida?

When is software enough?

When every exchange and wallet connects cleanly, transfers match and there are no DeFi or staking gaps. Records a Florida Crypto Investor Should Gather

The IRS says to keep records for 3 years in the ordinary case, with longer periods in the situations its page lists. For crypto, the records are what let anyone prove your cost basis.

  • Full transaction exports from every exchange you have used, including closed accounts.
  • Every wallet address you control, on every chain.
  • Forms 1099-DA, 1099-B and 1099-MISC received from platforms.
  • Prior-year federal returns that reported crypto, so the new figures continue from them.
  • Notes on transfers between your own accounts, and on any lost or stolen funds.
  • For a company or LLC, its formation documents and its federal classification.
