German crypto tax can be favourable. Provided your records can support it.

A magnifying glass highlighting crypto data being analysed

Don't pay tax on gains that fall outside the 1-year rule.

For privately held crypto, a disposal more than 1 year after acquisition will generally fall outside the taxable private disposal rules in §23 EStG. That sounds simple until the same asset has been bought repeatedly, moved between wallets, swapped for other crypto or earned through staking. We reconstruct acquisition dates and transaction history so the holding period can be supported by the underlying records rather than guessed.

The €1,000 Freigrenze is a threshold, not a €1,000 deduction.

Germany's Freigrenze applies to the combined annual profit from private disposal transactions under §23, not to each crypto transaction separately. If the relevant total is below €1,000, the gains can remain tax-free. Once the threshold is reached, it is not simply the amount above €1,000 that becomes taxable. Getting the transaction history right matters.

// who we are

"In Germany the 1-year rule gets most of the attention, but the real work is proving when assets were acquired and what happened to them after that. We built CountDeFi for exactly this, to provide the accurate data your tax return depends upon."

Accurate mining reporting, from the first payout to the final sale

German crypto accounting presents two separate problems. The first is transaction history. For crypto held as private assets, the tax treatment of a disposal can depend on whether the asset was held for more than 1 year. Crypto-to-crypto exchanges are disposals too, and the newly acquired asset starts a new holding period. That makes acquisition dates important. But investors rarely have a single, clean record. Their history may be spread across Bitpanda, Kraken, Binance, Coinbase, hardware wallets, MetaMask and years of on-chain transactions.

The second problem is classification. Germany's BMF provides specific guidance for areas including disposals of crypto-assets, passive staking, lending, mining, hard forks and airdrops. But not every part of DeFi has a dedicated rule. NFTs and liquidity mining, for example, are not specifically covered by the current BMF crypto guidance. That means complex on-chain activity has to be reconstructed accurately before the appropriate German tax treatment can even be considered. To provide comprehensive crypto accounting for German taxpayers, CountDeFi collects your full records, traces transfers between your own wallets, identifies acquisitions and disposals, calculates euro values, documents holding periods and produces a coherent reporting package. The result is a crypto tax report that you or your German tax professional can use to complete your final tax return.

Why German crypto investors hire CountDeFi accountants

Most people do not need help because they bought Bitcoin once and left it on an exchange. They come to us when the transaction history has become difficult to prove. They have bought the same asset at different times. Moved it between exchanges and their own wallets. Swapped one token for another. Earned staking rewards. Used DeFi protocols. Lost access to an old account. Or discovered that the tax software result does not match what actually happened. Those details matter in Germany. A missing acquisition date can change whether a disposal falls inside or outside the 1-year period. An unidentified transfer can appear to be a disposal. An incorrectly classified reward can distort both the income calculation and the acquisition history used later. We reconstruct the history before relying on the tax calculation. That gives you a report built from the actual transactions rather than assumptions made by the software.

// TAILORED PRECISION

Why tax software alone can't finish a complex German crypto report

Tax software is a useful starting point. It is not a substitute for clean data. Koinly, for example, is a genuinely good crypto tax engine. It is why we use it and why CountDeFi is Koinly's #1 Global Accounting Partner. But software can only calculate from the information it has been given. It cannot always know that a withdrawal from Kraken and a deposit into your Ledger were the same assets moving between your own wallets. It cannot recover records from an exchange you used 4 years ago. And it cannot reliably interpret every DeFi interaction simply from a transaction hash. Those errors matter when your German report depends on acquisition dates, holding periods and consistent wallet-level records. So we handle that work ourselves.We reconstruct the history, identify missing and incorrectly classified transactions, review acquisition dates and euro values, and then use the software to calculate from a clean dataset. If you already have a Koinly portfolio, we can work directly from it.

Frequently asked questions

Can you help with crypto tax reporting if I live in Germany?Do you handle both business and hobby miners?
Yes. We work with crypto investors who have German tax reporting obligations, including people with complex histories across exchanges, self-custody wallets and DeFi. We reconstruct the crypto activity and prepare the reporting package needed for the German return. Where German tax advice or filing by an authorised German professional is required, the report can be supplied to your Steuerberater.

How is staking taxed in Germany?Can you deduct my mining equipment and electricity?
Passive staking rewards are generally treated as other income under §22 no. 3 EStG and valued when received. The current BMF guidance also confirms that using currency or payment tokens in this way does not extend the normal disposal period to 10 years. When the rewarded crypto is later disposed of, its subsequent disposal may also need to be considered separately.

How does Germany's 1-year crypto rule work?
For crypto held as private assets, a disposal within no more than 1 year of acquisition can fall within the private disposal rules under §23 EStG.A disposal after the 1-year period will generally fall outside those rules. The important part for a complex portfolio is establishing which units were acquired when. Crypto-to-crypto exchanges also count as disposals and create a new acquisition for the asset received. We reconstruct those dates from the underlying records.

Can you handle DeFi and NFTs under German rules?
Yes, from a transaction reconstruction and reporting perspective. This distinction matters because the current BMF crypto guidance does not provide specific rules for every DeFi transaction. NFTs and liquidity mining are expressly outside the scope of the current BMF letter. We reconstruct what actually occurred on-chain and separate the transactions so the appropriate German tax treatment can be determined and documented.

What is Germany's €1,000 crypto tax Freigrenze?
The €1,000 Freigrenze applies to the aggregate annual profit from private disposal transactions under §23 EStG. It is not a separate €1,000 exemption for each cryptocurrency or transaction. If the relevant annual profit is below €1,000, it remains tax-free under the rule. At €1,000 or above, the Freigrenze no longer applies.

What does German crypto tax reporting cost? We do not bill by the hour.Our plans scale with transaction volume and complexity, and include the software, transaction reconciliation and completed tax reporting package.

Can you help if I am a US citizen living in Germany? Yes. We regularly work with people whose crypto activity creates reporting obligations in more than one country.For US persons in Germany, we can reconstruct a single underlying transaction history and prepare the relevant crypto reporting outputs so the German and US calculations are based on consistent data.

Can you help with my entire crypto portfolio? Yes. CountDeFi works with complex crypto portfolios involving trading, staking, lending, DeFi, NFTs, mining, futures, prediction markets and multiple exchanges and wallets.We reconstruct the portfolio first, then produce the reporting outputs required for the jurisdictions we support.
