German crypto accounting presents two separate problems. The first is transaction history. For crypto held as private assets, the tax treatment of a disposal can depend on whether the asset was held for more than 1 year. Crypto-to-crypto exchanges are disposals too, and the newly acquired asset starts a new holding period. That makes acquisition dates important. But investors rarely have a single, clean record. Their history may be spread across Bitpanda, Kraken, Binance, Coinbase, hardware wallets, MetaMask and years of on-chain transactions.
The second problem is classification. Germany's BMF provides specific guidance for areas including disposals of crypto-assets, passive staking, lending, mining, hard forks and airdrops. But not every part of DeFi has a dedicated rule. NFTs and liquidity mining, for example, are not specifically covered by the current BMF crypto guidance. That means complex on-chain activity has to be reconstructed accurately before the appropriate German tax treatment can even be considered. Most people do not need help because they bought Bitcoin once and left it on an exchange. They come to us when the transaction history has become difficult to prove. Tax software is a useful starting point. It is not a substitute for clean data. Koinly, for example, is a genuinely good crypto tax engine. How is staking taxed in Germany?Can you deduct my mining equipment and electricity?
Passive staking rewards are generally treated as other income under §22 no. 3 EStG and valued when received. The current BMF guidance also confirms that using currency or payment tokens in this way does not extend the normal disposal period to 10 years. When the rewarded crypto is later disposed of, its subsequent disposal may also need to be considered separately.
How does Germany's 1-year crypto rule work?
For crypto held as private assets, a disposal within no more than 1 year of acquisition can fall within the private disposal rules under §23 EStG.A disposal after the 1-year period will generally fall outside those rules. The important part for a complex portfolio is establishing which units were acquired when. Crypto-to-crypto exchanges also count as disposals and create a new acquisition for the asset received. We reconstruct those dates from the underlying records.
Can you handle DeFi and NFTs under German rules?
Yes, from a transaction reconstruction and reporting perspective. This distinction matters because the current BMF crypto guidance does not provide specific rules for every DeFi transaction. NFTs and liquidity mining are expressly outside the scope of the current BMF letter. We reconstruct what actually occurred on-chain and separate the transactions so the appropriate German tax treatment can be determined and documented.
What is Germany's €1,000 crypto tax Freigrenze?
The €1,000 Freigrenze applies to the aggregate annual profit from private disposal transactions under §23 EStG. It is not a separate €1,000 exemption for each cryptocurrency or transaction. If the relevant annual profit is below €1,000, it remains tax-free under the rule. At €1,000 or above, the Freigrenze no longer applies.
