Short answer: in Germany, only an authorised adviser such as a Steuerberater may give you tax advice and file your return as a business. A crypto tax accountant does the other half: rebuilding your transaction history across exchanges and wallets and producing the gain and income figures your Steuerberater reviews and files. Complex portfolios usually need both.

Most German crypto investors who look for help are not short of advisers. They are short of figures. A Steuerberater can tell you how a staking reward or a sale inside the one-year window is treated, but someone still has to work out, transaction by transaction, which coins were sold, when they were bought, and what they cost. When the history runs across five exchanges, a hardware wallet and a few DeFi protocols, that work takes longer than the return itself.

This guide explains who may do what under German law, what a crypto tax accountant contributes, when you need both, and what to ask before you hire anyone. I am Chris Herbst, founder of CountDeFi. We are crypto tax accountants: we reconcile crypto transaction histories and prepare the reports that clients and their own advisers file from. We do not file returns. I am a Chartered Business Accountant in Practice (CBAP) with the Chartered Institute for Business Accountants and a General Tax Practitioner (GTP) with the South African Institute of Taxation. Our crypto tax accounting service explains how an engagement works.

Who Can Help With Crypto Taxes in Germany?

German law draws a clear line around tax advice, and it is the first thing to understand before choosing anyone.

Who is allowed to give tax advice in Germany?

Only people and organisations the law authorises. The Tax Advisory Act says that help in tax matters darf geschäftsmäßig nur von Personen und Vereinigungen ausgeübt werden, die hierzu befugt sind: it may be provided as a business only by those authorised to do so. The same section adds that this applies whether the work is full-time, part-time, paid or unpaid. Section 3 then lists who is authorised, starting with Steuerberater, Steuerbevollmächtigte, Rechtsanwälte, Wirtschaftsprüfer and vereidigte Buchprüfer, and their firms.

What counts as tax advice under that rule?

The Act defines help in tax matters as any activity in someone else's affairs sobald sie eine rechtliche Prüfung des Einzelfalls erfordert, as soon as it requires a legal assessment of the individual case. Deciding how your particular transactions are taxed, and putting that position on your return, is that kind of work. It is why the legal review of a crypto return sits with your Steuerberater.

Can a Lohnsteuerhilfeverein help with crypto?

Sometimes, within limits. A Lohnsteuerhilfeverein, an income tax help association, may assist members whose income comes from nichtselbständiger Arbeit (employment) and certain pensions and benefits. It may also help where the member has further income that must be declared in the assessment, which can include private crypto sales. It may not help a member who has business, self-employed or farming income or makes VAT-liable sales, and its authority is auf die Hilfeleistung bei der Einkommensteuer und ihren Zuschlagsteuern beschränkt, limited to income tax and its surcharges. An employee with a modest crypto history can often use one; an active trader whose activity may be commercial is outside its scope.

Where does a crypto tax accountant fit?

Before the adviser. The work that slows a crypto return down is data work: collecting exports, matching transfers between your own wallets, finding missing purchase records, and calculating each disposal and each income event in euros. A crypto tax accountant does that work and hands over a reconciled report. Your Steuerberater then applies German law to your facts and files. Anyone who is not authorised under section 3 may nicht geschäftsmäßig Hilfe in Steuersachen leisten, so check that whoever signs off your return holds one of the listed titles.

The German Rules Your Figures Have To Support

You do not need to master German crypto tax law to hire well, but four rules decide what the figures have to show. Our Germany crypto tax guide covers each in depth, including the Federal Ministry of Finance guidance on staking and lending.

When is selling crypto tax-free in Germany?

When you held the units for more than a year. Private sales of assets other than land are taxable where der Zeitraum zwischen Anschaffung und Veräußerung nicht mehr als ein Jahr beträgt, the period between acquisition and sale is not more than one year. Past that point a private sale is outside this rule. That is why every disposal needs the acquisition date of the specific units sold, not an average.

Why does the 1,000 euro limit make exact figures matter?

Because it is a threshold, not an allowance. Gains from private sales stay tax-free wenn der aus den privaten Veräußerungsgeschäften erzielte Gesamtgewinn im Kalenderjahr weniger als 1 000 Euro betragen hat: only if the total gain for the calendar year is under 1,000 euro. Reach the limit and the whole gain is taxable, not just the excess. A reconciliation error of a few hundred euros can move a year from tax-free to fully taxable.

How is the gain on a crypto sale measured?

The statute defines it as the difference between the Veräußerungspreis, the sale proceeds, and the acquisition costs plus Werbungskosten, the expenses connected with the sale. Fees paid to buy and to sell therefore belong in the calculation. Each figure has to be in euros at the time of the transaction.

How are staking and lending rewards taxed?

They are commonly reported as income from services under section 22 No. 3 of the Income Tax Act, which our Germany guide sets out. That category is not taxed if it totals weniger als 256 Euro im Kalenderjahr, less than 256 euro in the calendar year. Like the 1,000 euro limit, it is a threshold: at 256 euro or more, all of it is taxable. Reward streams that pay daily across several protocols are where this figure is most often wrong.

Can crypto losses be used?

Only against the same kind of gain. Losses from private sales may be offset nur bis zur Höhe des Gewinns, only up to the gains from private sales in the same calendar year. Unused losses can be carried back one year or forward against future private sale gains. Losses that are not reported cannot be carried, so a year with a net loss is still worth reconciling and declaring.

What a Crypto Tax Accountant Does for a German Resident

The deliverable is a set of figures your adviser can rely on, with the workings behind them.

How is the transaction history rebuilt?

Every exchange export, wallet address and protocol interaction is collected and combined into one ledger. Transfers between your own accounts are matched so they are not counted as sales and purchases. Where an exchange no longer exists or an export is incomplete, the gaps are traced on chain or documented. Our guide to missing cost basis in crypto explains how that tracing works.

Why does matching units across wallets matter in Germany?

Because the one-year rule is tested on the units sold. If you bought on one exchange, moved coins to a hardware wallet and sold from a second exchange two years later, the acquisition date only survives if the transfer chain is intact. A broken chain makes the units look newly acquired, which can turn a tax-free sale into a taxable one.

What does the finished report contain?

Disposals with dates, proceeds, costs and holding periods; income events with euro values at receipt; totals against the 1,000 euro and 256 euro thresholds; closing balances checked against what each exchange and wallet actually holds; and a list of any judgement points for your adviser. Your Steuerberater uses it to complete Anlage SO and decides the treatment of anything flagged.

When You Need Both a Specialist and a Steuerberater

Many German residents with crypto need only a Steuerberater, and some can use tax software alone. The split makes sense in a few situations.

Does a large number of transactions change the answer?

Usually. Thousands of trades across several exchanges, frequent transfers or automated trading strategies generate more data work than most advisory practices are set up for. Many Steuerberater prefer to receive reconciled figures rather than raw exports.

What about DeFi, staking and NFTs?

These produce transactions that exchange exports do not describe well: liquidity deposits and withdrawals, wrapped tokens, reward claims and bridge transfers. Each has to be identified before it can be treated. Our article on how DeFi is taxed describes the transaction types in detail; the mechanics are the same in Germany even though the tax rules differ.

What if records from earlier years are missing?

Then the current year cannot be right either. A sale this year draws on units bought in earlier years, and both the cost and the holding period come from those purchases. Rebuilding prior years is reconciliation work and is usually done before the adviser reviews the return.

How To Compare Your Options

The table sets out who does what. It describes roles, not a ranking.

OptionMay give tax advice and file for you?Typical role with crypto
SteuerberaterYes, listed in section 3 StBerGLegal review, treatment decisions, Anlage SO, dealing with the Finanzamt
LohnsteuerhilfevereinYes, for members within section 4 StBerG limitsIncome tax returns for employees with straightforward crypto activity

What should you ask a Steuerberater?

Ask how many clients with crypto they handle, whether they accept a reconciled report from a specialist or prefer raw exports, how they approach staking and lending income, and whether they have dealt with a Finanzamt enquiry on crypto. A clear answer to the second question tells you whether you need a separate specialist at all.

What should you ask a crypto tax accountant?

Ask whether they check closing balances against each exchange and wallet, how they handle missing purchase records, whether the report states holding periods per disposal, and whether they work with German residents' advisers. The same questions apply to any provider; our guides for the UK and Australia show how the split works in other countries.

What To Hand Your Adviser, and When

Timing matters because the deadline depends on whether an adviser prepares the return.

When is a German return due?

Without an adviser, returns for a calendar year are due spätestens sieben Monate nach Ablauf des Kalenderjahres, at the latest seven months after the year ends. Where a Steuerberater or another authorised adviser prepares the return, the deadline moves to letzten Tag des Monats Februar of the second year after the tax year, though the Finanzamt can call a return in earlier. Reconciled figures need to reach your adviser well before either date.

How long should you keep crypto records?

Keep exports, wallet addresses and supporting records for every year that can still be assessed, and for older purchases you still hold, because their cost and date are needed when you sell. Taxpayers whose positive surplus income is mehr als 500 000 euro in a calendar year have a statutory duty to keep the records behind that income for six years.

If You Are a US Citizen Living in Germany

US citizens resident in Germany have two returns to get right, and the crypto figures feed both.

Does the US tax a German resident's crypto gains?

Yes, for US citizens and resident aliens. The IRS says you are subject to tax on worldwide income from all sources wherever you live. It also treats digital assets as property, not currency, so the US calculation follows different rules from the German one, with no one-year exemption. A sale that is tax-free in Germany can still be a reportable gain in the US.

Can German tax be credited against US tax?

Often. The IRS explains that if you paid foreign taxes and are subject to U.S. tax on the same income, you may be able to take a credit or a deduction, and the credit is claimed on Form 1116. One reconciled history can produce both the euro figures for your Steuerberater and the dollar figures for your US preparer. Our US crypto tax accountants prepare the US side.

Frequently Asked Questions

Is crypto tax-free after one year in Germany?

For private investors, a sale of units held for more than one year falls outside the private sales rule in section 23 EStG. Sales within a year are taxable unless the year's total private sales gain is under 1,000 euro.

Can a Steuerberater file my crypto taxes?

Yes. A Steuerberater is authorised under section 3 StBerG to give tax advice and prepare your return, including the crypto figures on Anlage SO.

Do I need a crypto tax accountant as well as a Steuerberater?

Only if your history needs reconciling first: many exchanges, DeFi, staking across protocols, or missing records. Simple histories can go straight to the adviser.

What does a crypto tax report for Germany include?

Each disposal with dates, euro proceeds, costs and holding period, income events valued at receipt, totals against the 1,000 and 256 euro thresholds, and balance checks.

Is the 1,000 euro limit an allowance?

No. It is a threshold. If the year's total private sales gain is 1,000 euro or more, the whole gain is taxable, not only the part above the limit.

Can a Lohnsteuerhilfeverein do my crypto return?

It can for employee members with further income such as private crypto sales, but not for members with business or self-employed income, and only for income tax.
